If there was negligence on either party's part, definitely!
Consult one of the ambulance chaser firms that advertise on TV. In this economy they're all hungry, so they'll know if there's any money to be had! A firm that takes it on contingency usually charges 30-40% of the settlement. Usually a settlement is negotiated based on medical costs (1/3 to the doctor, 1/3 to the lawyer, 1/3 to you) But if there's negligence the figures could go higher...much higher!
