Isn't releasing helium balloons into the sky just postponing your littering?
Eventually it's gonna lose its buoyancy & fall to the ground. If I just left empty balloons on the ground it'd be littering. Also, I could (theoretically) get a fine for littering when I throw some plastic bags along the road. However, I don't think I'd get a fine for tying those bags to some helium balloons & releasing them into the sky, knowing full well that it will all eventually end up on the ground somewhere.
This is the exact reason why releasing balloons into the air is now an illegal act.
Code ยง 29.1-556.1 stipulates that it is illegal to release 50 or more irretrievable helium balloons within a one-hour period. The penalty is a fine of $5 per balloon, which is paid to an environmental endowment fund.
Besides the issue of littering, the issue of wildlife being endangered by these balloons are also a problem. Some fowl will eat the balloons, destroying their intestinal tracts.
